According to the Migration Department, 25.6 thousand people currently have work-based residence permits in the country.
Citizens of Ukraine, so the new procedure may affect them, but exceptions are also provided for.
After the new procedure comes into force, Ukrainians who do not have the right to temporary protection will be able to work in Lithuania only after obtaining a residence permit in the country, the Migration Department announces.
Until now, foreigners registered with the Migration Department and unable to return to Ukraine, who did not have the right to temporary protection, were exempted from the obligation to obtain a work permit if they met certain exceptions.
As of September 1, the exception is still valid only for foreigners who have applied for residence permits on the basis of work, highly qualified work or humanitarian work.
In all others, only foreigners with a valid residence permit will be able to work.
Also, after the entry into force of the new procedure, if a foreigner is not a war refugee, can return to Ukraine, has a residence permit for a profession that is not included in the list of missing professions, and applies for a residence permit on the basis of work, he must receive a positive decision from the Employment Service.
The department draws attention to one important exception, which is relevant for Ukrainians staying with the same employer.
If Ukrainians remain working for the same employer and apply for the extension of their residence permits, they will not need to apply to the Employment Service, including in cases where their profession is not included in the list of missing professions.
The new procedure will only apply to applications submitted after September 1
The Migration Department informs that until September 1 submitted requests for issuing or changing a temporary residence permit, as well as for issuing a national visa, will be considered under the conditions applicable until the mentioned date.
This procedure will be valid regardless of whether the employment relationship is started before September 1. or after it.
According to the department, foreigners do not need to rush to change the permits they have this year, if they are still valid for a long time.
The Migration Department reminds that in cases where a foreigner has been granted temporary protection and intends to apply for a temporary residence permit on the basis of work, he does not need to obtain a decision from the Employment Service regarding the conformity of the foreigner’s work with the needs of the Lithuanian labor market, if the foreigner is applying for a residence permit on the basis of work for the first time after the granting of temporary protection or such residence permit is changed, and the alien’s employer has not changed.
