The beginning of the school year in September is a bit like the transition to a new year: some see it as the best opportunity for a fresh start. The holidays make us think and a project has grown during the summer, new passions appear, another balance has come… It has been decided, it’s time to resign. A choice which, however, is not something and which cannot be achieved overnight. Or almost.

Generally, when you want to leave your job, it is necessary to continue working for the company for one, two or even three months. This is called notice, implementation so that employers do not find themselves in need with one less employee, without having time to organize. However, there are exceptions and few know or, at least, do not talk about it when you leave a company.

It is in fact possible that the resigning employee can negotiate the length of their notice period with their employer, up to the point of not receiving any notice at all. To do this, contact your employee or manager directly to inform them of your request: the law authorizes this. If both parties agree, then the notice period can be partially or fully reduced.

The request can be made orally or in writing, but it is better to send it by email or post in order to record the exchanges, in the event of a dispute. In general, the request is made in the resignation letter and can take this form: “By departing from the terms of my employment contract (or collective agreement), I thank you for voluntarily resigning from the notice period of (time in months) so that my departure will take effect on (date).” The employer’s response is also sent in a letter.

If you are an employer who dismisses an employee from notice, then the latter receives compensation. Since it is the boss who asks the worker to leave at night, he pays the month (month) salary that the worker should receive during his notice period.

Furthermore, there are two situations in which the employee has the right, de facto, to leave without notice: during the employee’s pregnancy. Then it is possible to leave your position at any time. Also, either within two months after giving birth, or at the end of maternity leave, the law allows you to leave your job (almost) without notice to raise your child. The employee, however, needs to inform his employer at least 15 days in advance.
