The Frankfurt district court had not admitted the charges against officials in the 1st district in Frankfurt because the chat groups were small and exclusive. The Attorney General disagrees.

In the proceedings regarding racist and anti-Semitic chats by police officers from the 1st district in Frankfurt, which were accidentally discovered during the investigations into the “NSU 2.0” threatening letter writer, the Frankfurt Public Prosecutor’s Office has submitted its opinion to the Higher Regional Court. She takes the view that, contrary to the decision of the Frankfurt Regional Court, the Frankfurt Public Prosecutor’s Office must allow the indictment and the main proceedings must be opened. As a spokesman said on request, the authority believes that 83 of the 101 alleged acts were actually disseminated in a criminal sense.

The Attorney General’s Office came to this conclusion after several prosecutors from the Central Office for Combating Extremism and Terrorism in Hesse evaluated the files, which consist of 40 Leitz folders with around 12,000 pages. After “detailed examination” the opinion was taken that the immediate appeal by the public prosecutor’s office against the decision of the district court “mostly (…) has a chance of success”.
