Roberto Jefferson is arrested

Federal judge Abby Ilharco Magalhães ordered this Wednesday (13) that former federal deputy Roberto Jefferson be put on trial by a popular jury for attempted murder against four federal police officers.

The decision refers to a case that occurred in October 2022, when Jefferson fired shots and threw light and sound grenades at the police officers who detained him on the order of Minister Alexandre de Moraes, of the Federal Supreme Court.

The incident resulted in minor injuries to two Federal Police officers. Roberto Jefferson admitted to having fired around 50 shots during the confrontation, but claimed not to have intended to kill the police officers.

Judge Abby Ilharco ruled out the futile reason qualification, however, she maintained other qualifications, including the use of a restricted firearm and the crime against authority in the exercise of the function. Furthermore, she recognized the connection of the case with other crimes, such as qualified resistance and illegal possession of adulterated weapons and grenades.

Roberto Jefferson’s preventive detention was maintained, and he remains hospitalized in a hospital in Rio de Janeiro with the authorization of Minister Moraes, due to his fragile health and depression.

The Federal Public Ministry had requested that the former deputy be put on trial by a popular jury for four attempted murders with possible intent, as well as for other crimes, including armed resistance and illegal possession of weapons and explosives.

The MPF argues that the amount of ammunition and shots fired by Roberto Jefferson demonstrates that he took the risk of causing the deaths of police officers during the incident. In addition, the former deputy also faces charges related to possession of illegal weapons and explosives, as well as qualified damages.

In a note, lawyers João Pedro Barreto and Juliana França David, who are part of Jefferson’s defense, reported “that although they respect the decision of the Federal Court of Três Rios, they disagree that Jefferson should go to a popular jury, and are awaiting a summons to manifest in the records.”
