Rocha Moya, willing to testify when summoned by the FGR on the “El Mayo” case

“Because they asked me on Friday (at the meeting at the National Palace with the President) ‘listen, are you going to testify?’ And I said no, but then they insisted, and I said, ‘oh yes! ‘And when?’ when the Attorney General’s Office calls me, that is, if the Attorney General’s Office calls me, I’ll go.”.

He even said that he does not even consider using his office immunity to avoid appearing, because – he quoted President López Obrador – he must appear before the authority when requested:

“They come and testify here (Sinaloa) or I go there, I have no problem with that (…) we all have to contribute to the world moving with the truth.”

He also said that he is willing to provide evidence of his presence in the US on July 25, the day in which the events in which Zambada García has implicated him through a letter took place:

“The Prosecutor’s Office has asked me to provide evidence that I was not there, so I will give it to them, if they ask me, I will give it to them.”

This is because on August 11, the FGR indicated in a statement that:

“As for the governor of Sinaloa, the FGR representation in that state has already contacted him to obtain all the relevant information that may be necessary.”

Rocha Moya’s comments come 20 days after the Federal Prosecutor’s Office, in addition to taking on the “El Mayo” case, will also take charge of the investigation into the murder of former rector Melesio Cuén, and pointed out various inconsistencies in the investigations carried out by its local counterpart:

“There is no mechanics of the facts of the site (…) Neither were the measures for preserving the body complied with by all the authorities involved, allowing an incineration that is contrary to forensic practices on homicide investigation.”

In addition to listing other irregularities:

• The body has a severe bruise on the head, and received 4 shots in the legs
• The gas station video has sound and only one shot can be heard
• The three gas station employees did not report hearing any gunshots
• The occupants of the van are not precisely identified

On August 13, the Sinaloa Prosecutor’s Office – headed by Sara Bruna Quiñones, appointed by Rocha Moya at the beginning of his six-year term – revealed a video after an alleged letter attributed to “El Mayo” was released on August 10 in which he relates that he was kidnapped while he was heading to a meeting with Melesio Cuén Ojeda to mediate with the governor regarding the succession at the Autonomous University of Sinaloa.

In the clip released by the Sinaloa agency, a truck can be seen arriving at a gas station, an employee attends to it, and then two men arrive on a motorcycle.

Then one of the men gets off the motorcycle, opens the passenger door and shoots at the occupants of the truck, where they are allegedly Hector Melesio Cuen Ojeda and his companion, Fausto “N”.

The events occurred on July 25th at 9:57 p.m., same day that the arrest of Ismael “Mayo” Zambada was recorded.

In its report dated August 11, the Attorney General’s Office indicated that it opened the investigation file SON/HSO/0001/882/2024for the possible crimes of illegal flight; illegal use of air facilities; violation of immigration and customs legislation; kidnapping; treason (Article 123 of the Federal Penal Code); and whatever else may arise.

In addition, dependency, homicide, illegal deprivation of liberty, and the resulting profit-sharing would continue.

That day, the federal agency indicated that it carried out proceedings in the area known as Culiacan Pedregal Gardens and at the airfield that was possibly used in this case; today he detailed that:

“He located the property where the probable crimes of illegal deprivation of liberty, homicides, injuries and acts linked to forced disappearance took place, in which the aggression that led to the death of Hector ‘N’.

The exterior of the building is already protected by the Criminal Investigation Agency (AIC)of the FGR, while the respective proceedings are carried out.”

In addition, the vehicles used for the possible kidnapping have already been identified.
