Cancellation of orders at abnormally low prices due to a failure on the website of the Ozon marketplace is illegal, TASS reports, citing the press service of Rospotrebnadzor.
On the night of November 1, on the marketplace website, some goods fell sharply in price: it ranged from 1 to 50 rubles. Ozon later canceled orders made at those prices.
“If a technical failure occurs on a seller’s or marketplace’s website, characterized by the setting of“ wrong prices ”or discounts, this does not change the situation legally for the consumer, since even sales for 1 ruble are a common practice of drawing attention to a particular product or brand. However, in such cases, the seller, of course, has the right to go to court with a demand to terminate the contract. However, the seller cannot act unilaterally, terminate the contract or recognize it as not concluded by law, “Rospotrebnadzor said.
At the same time, the department emphasized that, according to observations, many consumers are ready to refuse the transaction themselves if they are correctly explained the reasons for the impossibility to execute it. But the consumer has the right to demand the execution of the concluded contract, including the transfer of goods at a paid price or compensation for losses that are associated with the exercise of his right to receive the purchased item.
