The Social Insurance Code regulates the possibility of recalculating labor pensions, the National Insurance Institute (NII) reports. This applies to older people who continue to work after retirement.
There are two ways to recalculate.
The first is ex officio – without the pensioner submitting an application. In this recalculation, the social security experience acquired by the person in the period after the grant, respectively – after the last recalculation, is additionally taken into account.
The second is at the request of the pensioner – in these cases, the pension can be recalculated with the additionally acquired insurance experience and insurance income in the period after its granting, respectively – after its last recalculation, if this is more favorable for the pensioner.
In the official recalculation of pensions, starting from April 1 of the year, the data submitted by the insurers are taken into account, and for self-insured persons – the data on the paid insurance contributions, which refer to the period up to and including December 31 of the previous calendar year and which are available in the information system of the NSI as of March 1 of the current calendar year.
This recalculation applies to all pensioners who receive personal labor pensions, have completed service in the previous calendar year and have not submitted an application for recalculation of the pension with additional social security experience and social security income acquired after retirement.
When performing the recalculation from April 1 each year, no period of social security service after retirement is missed – each annual recalculation is carried out with an additional 12 months of social security service, if the person has worked them in the previous calendar year (respectively – with as many months, as worked).
The recalculated amount of the pension is paid 12 months before the next annual recalculation, reflecting the update according to the Swiss rule from July 1 of the respective year. The regulated official recalculation of pensions is always carried out from the same date every year, and each time the additional insurance experience acquired by the person from the last calendar year is added, i.e. the pension is recalculated every 12 months, adding up to 12 months of insurance experience, as long as the pensioner worked and was subject to insurance in the relevant period.
On the same principle, the annual recalculation of the pensions of the working pensioners is carried out according to the applications submitted by them, on the basis of which the social security experience and social security income provided by them are taken into account (if this is more favorable for the person) after retirement until the date of the recalculation. In these cases, the recalculation is carried out from the 1st of the month following the date of submission of the application, and each subsequent year the pension is recalculated from the same date.
Therefore, and in this order, the pension is recalculated every 12 months, adding up to 12 months of insurance experience, if the pensioner worked and was subject to insurance in the relevant period.
