Based on the assumed minimum income, one in two was taxed freelancers who have already submitted their declaration. Few of them asked him a new way of taxation to avoid control at tax office which not only reaches a depth of 5 years, but opens all accounts, even those of relatives. According to the financial staff, the little interest registered in questioning the new method of taxation is due to two reasons: at the start and most importantly, most of them do not want the tax authorities to start looking for them and their relatives, and, in second place, most are awaiting the decision of the Council of State to declare the law unconstitutional and also the decision regarding the protest procedure. That is, they prefer to pay 1,000 euros more, as they note, than to check.
Appeals to the Supreme Court
On the other hand, the professionals which appealed to the supreme court to give a completely different explanation. Specifically stress on the “K” “We will not legitimize Pitsili’s decision, when we are faced with the supposed income. The less, the stronger the message we send them Justice on the unconstitutionality of the law as a whole”, and stating that the law must be annulled because its provisions are contrary to the constitutional principles of equality of citizens before public burdens.
What the evidence shows
The IS data from the tax administration of the 209,190 tax returns submitted by the self-employed and freelancers to date show the following:
• 52.81% of professionals or 110,490 taxpayers fall within the income assumption. That is, the taxable incomes they declared are lower than the presumptive minimum income, they are taxed as a result of the presumption, and they are asked to pay increased amounts of tax compared to previous years. And this is despite a 50% reduction in the pretentious fee. THE tax the yield on them is double or triple compared to previous years.
• Of the taxpayers for whom the minimum taxable income was activated, only 679 showed an interest in contesting the presumptive calculation method. That is, in the statement they submitted, they filled in codes 443-444 of E1. Of course, to complete the process, the above must, no later than within 60 days from the end of the deadline for submitting the declaration, fill in a questionnaire about their financial situation and living conditions (of themselves, spouse and their dependent members), which will be assessed during the tax audit).
• Out of the 679, only 66 people completed the process and who will be waiting for it tax audit. However, they are obliged to pay the tax they owe and then the tax authorities will start the audit procedures.
Only 66 professionals submitted a statement challenging the new way of taxation.
It is recalled that volunteers have appealed to the Council of State asking for the annulment of the law providing for the calculation of their taxable income in a presumptive manner. They also ask that the AADE’s decision on the audit be annulled for those who dispute the amounts charged by the tax office.
Average tax increased
The average tax that taxpayers who received a debit settlement note must pay has increased by 20% compared to the corresponding period last year. This development is mainly the result of the change in the way professionals are taxed, who, as mentioned above, are required to pay double or triple the tax compared to last year. Of course, the tax they pay is at the same level as the taxes paid by employees. According to AADE data, 4.1 million declarations have been submitted so far and about 2.5 million remain to complete the relevant process. The liquidated data shows the following:
• 48.61% of the declarations submitted are zero tax.
• In the case of 21.49% of the tax declarations, a tax refund was received, which reaches 288 euros on average. Based on AADE data, 878,192 taxpayers are entitled to a tax refund, and the total amount reaches 253.4 million euros.
• 29.9% of taxpayers are required to pay additional tax on income earned in the previous year. Specifically, in the case of 1,221,867 declarations the result of the debit liquidation, and the total amount of the tax was 1.55 billion euros. The average tax for these declarations is 1,270 euros.
The payment
It is noted that taxpayers with a debit statement have the opportunity to repay the tax in different ways and in more than 8 installments provided by the Ministry of Finance. In particular, they can benefit from the permanent regulation of the Ministry of Finance, and those who pay the tax in one lump sum by July 31 will have a 3% discount. If they choose the fixed arrangement of the Ministry of National Economy and Finance, the installments are interest-bearing and the interest rate is 4.34% for the 12 installments and 5.84% for the 24 installments. To be included in the settlement, no installment of the settlement debt needs to be overdue. The application for inclusion in the regulation must be completed and submitted electronically together with a relevant responsible declaration.
