The National Consumer Secretariat (Senacon), linked to the Ministry of Justice, initiated administrative proceedings against the company 123milhas, based on evidence of violations of legislation relating to systematic breach of contracts. The information was published in Official Gazette of the Union (DOU) on Thursday, 19. When contacted, 123milhas stated that “this procedure was already initiated as a preliminary investigation” and that it is collaborating with Senacon.

The company will have 20 days to present its defense.

“At this stage of the procedure, the company will continue to contribute to clarifying the facts and integrating all control bodies in resolving the debts that are listed in the Judicial Recovery”, stated, in a note, to 123milhas.

According to Senacon, the decision to initiate the process aims to clarify the facts and determine whether the company violated the Consumer Protection Code (CDC).

The secretariat also ordered the sending of a copy of the decision to the bodies and entities that are part of the National Consumer Protection System, for information and the adoption of relevant measures.

“Senacon has acted firmly, within its competences, in compliance with the rights of consumers, investigating the responsibility of the company 123 Milhas. The company had already been notified to provide information about the suspension of promotional packages, and now, should provide clarifications on the repeated failures in the provision of services”, said the national Consumer Secretary, Wadih Damous, in a statement.

123milhas announced in August the suspension of travel packages from its cheaper “Promo” line, which had already been paid for by customers, offering only the option of refunds in vouchers – that is, coupons for use in the company itself.

At the end of the same month, the Minas Gerais Court accepted 123 Milhas’ request for judicial recovery, but it was provisionally suspended after Banco do Brasil (BVMF:) filed an appeal. The bank alleged that the company did not present all the documents required to enable the judicial recovery to be processed.

In September, the Court extended the judicial recovery of 123milhas to Maxmilhas and Lance Hotéis, other companies in the economic group. Together, the companies owe more than R$2.5 billion to creditors.

This month, the Parliamentary Commission of Inquiry (CPI) on Financial Pyramids recommended the indictment of 45 people, including eight partners of 123milhas.

The company denied that it had acted as a financial pyramid.
