A 40-year-old man from Switzerland has been sentenced to 13 months in prison for threats, insults and racial discrimination, with the sentence adjourned for a permanent measure.

A 40-year-old Swiss man was convicted on Monday at the Hinwil District Court (ZH) of threats, insults and racial discrimination. He got 13 months in prison. The sentence is postponed in favor of a permanent measure.

The defendant is also fined 30 francs (4,200 francs) for 140 days. The judgment is not yet final. It can be appealed to the Supreme Court of the Canton of Zurich.

According to the judgment published on Monday, the defendant suffers from personality disorders and possibly schizophrenia. The public prosecutor asked for a sentence of 12 months in prison.

The accused is accused of insulting, threatening and saying racial slurs against two dark-skinned youths on a sports field. He allegedly told one of them that he would have to return to Africa as a “negro”. He also allegedly hit a fence with a hammer and uttered insults.

According to the prosecution, he also told the second young person that he had never seen “a black person wearing a German brand of clothing”, referring to the young person’s Adidas brand of tracksuits. The accused also allegedly saluted Hitler.

The forty-year-old man claimed in court that the young people had threatened him. He would only reprimand them for crossing “his basketball court”. During the trial, the defendant described himself as an untouchable, hard-working citizen. He claimed not to be racist. His cousin married an African man, he said.
