The Fourth Section of the Provincial Court of Valencia sentenced a man and a woman who killed a friend on February 9, 2023, robbed him and burned him to 26 years and 25 years and three months in prison respectively in Gandia.
The magistrate who presided over this trial thus applies the guilty verdict issued by a popular jury on November 13, after the oral trial held a few days earlier.
The sentence considers both defendants guilty of the crimes of murder with the aggravating circumstance of abuse of superiority, arson with danger to the person and robbery with violence. For this last crime the court appreciates the aggravating circumstance of recidivism in the case of the now convicted man.
The two convicts will have to compensate each of the victim’s two sisters with 20,000 euros as civil liability.
Moreover, they will have to pay the insurance company of the property where the events occured the sum of 2,550 euros for the damage caused by the fire that broke out in the building.
The popular court,which refused to accept any request for mercy that could be presented by the prisoners,considered it proven that both of them went,at 10.40 am on the day of the events,to the victim’s home in Gandía,with the which they were united.
There they attacked him with a butcher’s ax and a knife - a kitchen knife or similar – with which they inflicted numerous blows on his head which caused injuries incompatible with life.
In that attack, according to the popular jury, they took advantage of their numerical superiority over the attacked. Both defendants acted in concert and with the intention of ending their own lives or accepting that their conduct could cause the victim’s death.
