The Superintendency of Industry and Commerce (SIC) announced that on September 23 and 24, 2024, administrative inspection visits were carried out at the facilities of Plural Comunicaciones SAS (Channel 1), Caracol Televisión SA and RCN Televisión SA

The main objective of these visits was to collect information on the advertising market on open national television and audience measurement mechanisms.

These inspections are part of a preliminary investigation stage, coordinated by the Competition Protection Delegation.after receiving information from the Communications Regulatory Commission. The SIC indicated that the purpose is to verify compliance with the rules that govern free economic competition in the country.

According to the statement issued, the Superintendency was able to access to documents, reports, books and computer equipment in order to collect necessary evidenceThese actions were carried out under the guidelines established in ruling C-165 of 2019, which authorizes the SIC to carry out inspections in order to verify the conditions of competition in the market.

It is important to note that during these visits no equipment was taken possession of and all data extraction was carried out with the consent of the information holders.In addition, the Superintendency highlighted the collaboration received from the legal advisors of the inspected channels.

The SIC stressed that these inspections were carried out in compliance with the constitutional rights of the companies involved. The statement highlights that the Constitutional Court has validated the practice of these visits as part of the powers of the Superintendency.recognizing the importance of the surprise factor in obtaining relevant and necessary evidence in investigations into free competition.

Finally, it was confirmed that during the inspections, the inspected companies enjoyed all guarantees of their fundamental rights, including the right to freedom of the press.
