Greater organizational flexibility for the Public Administration and lowering of the share of agile work in the Pola, the organizational plans of agile work that must be adopted by the administrations on January 31 of each year. The “extension decree” approved on April 29 by the Council of Ministers innovates the discipline on what we improperly call smart working and cancels the obligation of agile work for half of public employees. Minister Brunetta stressed that the experimentation induced by the pandemic would be treasured, but also that now it is possible to introduce on the one hand the flexibility consistent with the restart phase of the commercial activities we are experiencing and on the other the full organizational autonomy of the offices. For the ministry, therefore, there is no contradiction between the regulatory intervention on smart working and the collective agreement that will have to regulate the regulatory institutes of agile work, as stated in the note from the Department of Public Administration. The organizational flexibility required by the FP CGIL – it is explained – strengthened precisely by the rule of the Proroghe decree which eliminates a minimum threshold, but leaves the administrations free to identify which activities can be carried out in agile work and how many employees to assign to them. And this until the end of 2021 or earlier, if the national collective labor agreements come into force.
