With the extension of the state of emergency to January 31, 2021, all the simplified Smart Working rules valid for private and public sector employees remain in force. Agile work for 50% of Public Administration employees has been extended until 31 December. The parent who is an employee can perform agile work for the entire period of the quarantine of the child under 14, ordered by the ASL. If there is no possibility of smart working, one of the two parents can have a period of leave for which the parent is granted an allowance equal to 50% of the salary. What happens from February 1st? It is no longer possible for companies to place workers in smart working unilaterally and without individual agreements. The private sector will have to provide for an agreement signed by individual workers. It will have to establish methods of execution, number of days, instruments allowed, overtime calculations, rest times and disconnection times.
