South Tripoli Court rejects request to cancel session to elect State Council presidency

The South Tripoli Primary Court rejected the request to cancel the session to elect the presidency of the Supreme Council of State.

According to the “Wal” agency, “members of the House of Representatives, Abdul Fattah Al-Habloos, Muhammad Al-Hadi, and Youssef Al-Ahyoul, submitted to the court a request to invalidate the session, based on the participation of members Abdul Salam Ghuwaila and Fawzi Al-Aqab in the session to elect the president, despite the end of their membership in the council.”

The head of the court confirmed that “the participation of members Abdul Salam Ghuwaila and Fawzi Al-Aqab was public, and they voted without anyone objecting to their participation, except after the end of the election process, and on this basis he decided to reject the request.”

Earlier, the Legal Department of the Supreme Judicial Council issued a decision in which it confirmed that “the dispute in the Supreme Council of State regarding the ballot paper for the election of the office of the Council’s presidency is not within its jurisdiction to decide.”

The administration said in response to a letter addressed to it by Khaled Al-Mishri, a member of the council and one of the competitors for the council presidency, “It is within its jurisdiction to express a legal opinion on what is presented to it by public administrative bodies, and that deciding on the legality of the disputed paper is not within its jurisdiction.”

Khaled Al-Mishri won the elections for the presidency of the State Advisory Council by one vote after obtaining 69 votes in the second round, compared to 68 votes for his competitor, Mohamed Takala. However, this was not officially announced due to objections to the results by some members. The objection was about the legality of one of the members’ votes after writing Mohamed Takala’s name in a place other than the designated one.

Elections for the presidency of the Supreme State Advisory Council are held every year, and three presidents have held the presidency of the council so far: Abdul Rahman Al-Suwaihli, Khaled Al-Mishri, and Muhammad Takala.
