A man in his 40s who hired a private detective to obtain evidence of his estranged wife’s affair and a man in his 50s who received money to perform related work were sentenced to fines.
According to the legal community on the 25th, the Gwangju District Court’s 4th Criminal Division (Presiding Judge Lee Gwang-heon) sentenced Mr. A (49), a husband who was indicted on charges of violating the Stalking Punishment Act, to a fine of 500,000 won. In addition, private detective C (51), who received money from Mr. A and spied on his wife, Ms. B, was sentenced to a fine of 1 million won.
Mr. A is accused of ordering private investigator C, whom he met through an online search last June, to stalk his wife. Mr. C is accused of accepting Mr. A’s request and stalking his client’s wife, Ms. B, on several occasions that same month.
The court ruled, “Mr. C actively searched for the victim’s movements while waiting for a long time and reported the results in detail to Mr. A. The victim felt anxious as he repeatedly stopped his car to try to shake off the suspicious vehicle that was following him.”
He continued, “It is acknowledged that they committed stalking crimes, such as looking around the inside of the workplace building and questioning the parking lot manager. It is difficult to see it as a legitimate act permitted by social norms,” and explained the reason for sentencing, saying, “The defendants’ stalking crime is sufficiently acknowledged.”
Mr. A asked Mr. C to confirm whether his wife was having an affair for use in a divorce case.
Mr. C received 3 million won as a service fee from Mr. A and chased the victim to his workplace in a car.
