State Council orders regulation of management of common ecosystems

The Council of State upheld the ruling of the Administrative Court of Cundinamarca, recognizing the demand of the Attorney General’s Office, which orders the National Government to regulate the procedures for coordination for the proper and harmonious management of the areas of confluence of jurisdictions between the Regional Autonomous Corporations and the System of National Parks or Reserves.

In light of the evidence cited by the supervisory body, the High Court agreed to the claims, modifying the paragraph of the judgment of July 9, 2024, issued by the Court, specifying that it must be the Ministry of Environment and Sustainable Development, who must, within a reasonable time of six months, complete the procedure undertaken to fully comply with the provisions set forth in section 2 of paragraph 3 of article 33 of Law 99 of 1993, consisting of “Regulating the procedures for agreement, planning and harmonious management of common ecosystems within the jurisdiction of two or more environmental authorities.”

Finally, the High Court’s ruling states that the ministry must issue reports every two months on the progress until its issuance, giving reason to the lawsuit filed by the delegate attorney for Environmental, Mining, Energy and Agrarian Affairs, Gustavo Guerrero and the Ninth Judicial Attorney II for Environmental and Agrarian Affairs of Barranquilla, Carlos Arrieta.

All living beings in ecosystems become part of the energy cycle when they disintegrate and become nutrients. Ecosystems are made up of many species such as plants, animals, fungi and bacteria that depend on each other.
