The Federal Supreme Court ( STF
) scheduled for next Tuesday (23) the trial of the complaints referring to over 131 involved in the coup acts
from the 8th of January. It is the sixth group investigated, totaling 1,176 of the 1,300 complaints filed by the Attorney General’s Office (PGR).

The trial will take place in the virtual plenary, a modality in which ministers deposit their votes in the electronic system of the STF and there is no in-person deliberation.

If the majority of the ministers accept the accusations, the accused will start to respond to a criminal action and become defendants in the process. They must answer for the crimes of incitement to crime and criminal association. The group is formed by those accused of acting as perpetrators and instigators of the acts.

The trial of the first complaints began last month. To date, the Court has made 795 defendants under investigation.

Access to cell phones of prisoners

In his dispatch, Moraes stated that access to the data is indispensable for “clarifying the facts” and investigating the disappearance of evidence against the accused. The minister pointed out that the information may still show the functions of each suspect in the attacks in Brasília.

“In the case of the file, the requirements are fully met, as the evidence collected so far reveals strong evidence of the commission of crimes by people arrested in flagrante delicto, and it is essential to obtain telematic data for the complete elucidation of the facts , above all to avoid the disappearance of evidence and to allow the continuation of the ongoing investigation”, said Moraes.
