Derek Dunne, of Markievicz House, Dublin, appeared before Letterkenny Circuit Court on an unspecified date and entered a guilty plea to unlawfully taking possession of and using a mechanically propelled vehicle without the owner’s consent on july 10, 2023.The vehicle in question, valued at €390,000, was recovered undamaged with the key still in the ignition in Sheriff Street, North Dublin.

According to court testimony, Dunne arrived at the Bus Éireann station in Letterkenny at 10:35 PM and waited until the last bus driver departed at 11:06 PM. CCTV footage showed him entering several buses before ultimately entering the vehicle he would steal at 11:52 PM. He remained in the driver’s seat for approximately 45 minutes before driving off at 12:40 AM.
During an interview at Pearse Street Garda Station, Dunne explained that he had intended to take a later bus but was informed it was full. He then made the impulsive decision to take a bus himself. The subsequent journey covered 237 kilometers along the M1 motorway.
Mitigating Factors and Legal Arguments
A barrister representing Dunne argued that his client acted on impulse and now fully understands the substantial risk of harm he created. While Dunne is currently in custody facing other charges, he has no previous convictions. The defense also highlighted Dunne’s difficult upbringing, including a family history of drug problems and his upbringing by his grandparents.He has experience working in the haulage industry, influenced by an uncle in the same field, but does not possess a heavy goods vehicle license.
“He regretted taking the bus the instant he had,” the barrister stated, adding that Dunne’s actions stemmed from panic rather than malicious intent.

Judge John Aylmer acknowledged the unusual nature of the offense and noted that there was no evidence of intent to deprive Bus Éireann of the vehicle. He initially indicated that the offense warranted a two-year prison sentence. However, considering Dunne’s early guilty plea, full cooperation with authorities, and limited criminal history – a prior conviction for speeding – he reduced the sentence to 18 months.
In a surprising turn, Judge Aylmer ultimately suspended the 18-month sentence entirely, placing Dunne on probation for 12 months.
