The national government issued Decree 2039 of 2023, a rule that is part of the 2022 tax reform and that implies that foreign digital platforms pay taxes beyond the 19% VAT with which these services are currently taxed.

The new rule is related to taxation for Significant Economic Presence in Colombia, which is applied when gross income from operations involving goods or services with clients in the country exceeds $1,327 million or 31,300 Tax Value Units, UVT.

Likewise, when a Colombian website or domain is used, or when marketing activities are carried out with more than 300,000 users and in Colombian pesos.

With the new decree, digital platforms that provide streaming services over the internet, such as Netflix, Spotify and Amazon, must choose between submitting their income tax return to the National Tax and Customs Directorate, Dian, or the alternative of paying a tax simplified corresponding to 3% of your bimonthly billing.

The tax affects companies dedicated to economic activities of digital services such as advertising, content (including applications), streaming of musical content, podcasts and movies.

In addition, forms of monetization based on Colombian user data would be included, such as online services from intermediation platforms and digital subscriptions to media, news, music, video or games.
