Eliminate the “bottlenecks” that could delay investments and the implementation of Pnrr projects and achieve 5 objectives with which to streamline procedures and speed up the country: halving the time for environmental assessments; a reduction of more than half of the waits for the authorizations for ultra-broadband; unblocking the 110% super bonus; acceleration of tenders and construction of important strategic works; strengthening of silent consent and substitute powers. Not only that: among the innovations introduced by the Legislative Decree there is also a rule that allows, in the event of appeals to the TAR, to continue without interruption the work of the works linked to the NRP without compromising the legitimate protections for companies. This is the ‘presentation form’ of the simplification bill approved definitively by the Chamber. -superbonus 110%: For all interventions that fall under the superbonus, including those concerning structural parts of the buildings and elevations, they can be carried out with a simple communication to the Municipality, certified by the technician (Cila-superbonus): the approved rules thus thin out the excess of bureaucratic requirements that have hitherto held back access to the measure, especially by condominiums. Excluded from the simplification, as can be seen from the slides of the Ministry of Public Administration, only the interventions involving the demolition and reconstruction of buildings. Maximum simplification also for interventions in free construction, for which a simple description will suffice. It will not even be necessary to present usability, given that the interventions provided for by the superbonus improve energy efficiency and anti-seismic efficiency.
– SIMPLIFICATION OF PROCUREMENT PROCEDURES: The rules passed by Parliament also contain important measures to simplify the procedures for awarding works, services and supplies which aim to reduce the time required for tender procedures and simplify the burdens on economic operators. Beginning with the “Certainty of the award provision even when there is an appeal (Article 48, paragraph 4)” which eliminated the limitation of the scope of application of Article 125 of the Code of the Administrative Process to only public works of competence state, or in any case financed for at least 50% by the state, for an amount equal to or greater than 100 million euros. In this way, in the event of an appeal against the acts relating to the award procedures financed, in whole or in part, with the resources provided for by the NRP, the NCP and the programs co-financed by the structural funds of the European Union, instead of taking over the contract already concluded between the Contracting Authority and the successful bidder, the person who wins any redemption is entitled to compensation only. This is to achieve two purposes: to ensure the effectiveness of the right to judicial protection of the unsuccessful economic operator and to guarantee the finality of the awarding measure adopted by the Contracting Authority which will no longer have to wait for the outcome of the judgment before starting the construction of the work. . The realization of the works can no longer be delayed by appeals.
