The Superintendent of Companies, Marco López Narváez, is under scrutiny by the National Assembly and faces a possible impeachment process by the Constitutional Court, according to a warning by Assemblyman Leonardo Berrezueta, of the Citizen Revolution (RC) bench.

Leonardo Berrezueta, representative of Azuay, said that López Narváez could be dismissed by the Constitutional Court due to an alleged failure to comply with a ruling related to labor issues. According to Berrezueta, last year a staff restructuring was carried out in the Superintendency of Companies, where several public servants were arbitrarily changed from one title to another without their consent, and in some cases, were demoted.

A group of nearly 30 affected employees filed a protective action with precautionary measures, and the constitutional court ruled in favor of the workers in two instances. The second instance ruling, issued on January 15, 2024, ordered the Superintendency to reinstate the employees to their original positions and respect their rights. However, Berrezueta stated that since then, López Narváez has not applied the ruling, which could lead to dismissal sanctions and possible criminal implications.

In addition to the failure to comply with the ruling, Assemblyman Berrezueta initiated an oversight process on an issue that affects national security: the insurance coverage of the radars in Montecristi in Manabí, which were the object of vandalism. The Interoceánica company, in charge of the all-risk coverage policy for the radars with the Ministry of Defense, has been the object of controversy.

According to Berrezueta, the Superintendency of Companies ordered Interoceánica to pay only $5,000,000 for the loss, when the total value is $7,200,000. The Ministry of Defense has initiated legal action against Interoceánica, which refuses to pay the full amount, arguing that they have the approval of the Superintendent of Companies.

Berrezueta said that López Narváez’s action harms the interests of the State and leaves the Ministry of Defense in a precarious situation with partial coverage of the Montecristi radar. This situation not only affects national security, but also calls into question the management of the Superintendency of Companies under the leadership of Marco López Narváez.
