The Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) confirmed the configuration of the next Legislature of the Chamber of Deputies, that despite the thousands of challenges presented, it will have the qualified majority of Morena, PT y PVEM.
With votes in favor of the president, Monica Soto, and the judges Felipe Fuentes, Reyes Rodríguez and Felipe de la Mata, as well as against Janine Otálora, the allocation of plurinominal deputies made by the National Electoral Institute (INE).
The composition of the Chamber of Deputies was left with Morena, PT and PVEM with 364 deputies; Fuerza y Corazón por México, made up of the PAN, PRI and PRD, in second place with 108 legislators; Citizen Movement would have 27 and one deputy would be independent.
The majority of judges agreed that the rules set out in the Constitution should be applied as has been done in the last five elections, since 2009, and could not be changed during the current electoral process.

With the majority vote, the Superior Court rejected the thousands of challenges, more than eight thousand, from parties and members of the Pink Tide, who asked to interpret the Constitution and that the limit of overrepresentation be applied by coalition and not by party, which meant taking away the majority rated 4T.
Philip of the Mata, Felipe Fuentes, Reyes Rodriguez and Monica Soto They indicated that the rules were not absolute and that the parties have the possibility of changing the legislation so that the allocation of proportional representation deputies is through a pure system, that is, that the political forces obtain the seats according to their voting percentages, but in the meantime a mixed system is in force.
In this regard, Judge Reyes Rodríguez issued a dissenting opinion to point out the legislative omission and link the Congress to legislate on the issue of the allocation of plurinominal seats and overrepresentation; however, he did not obtain the support of his colleagues.
For her part, Judge Janine Otálora said that she was not seeking to change the rules at the end of the electoral process, but rather a different method ofdesignation of plurinominal deputations.
The judge maintained her position that the coalition of Morena, PT and PVEM “They distorted the principle of allocation and accumulated power that exceeds constitutional limits” through their coalition agreement.
Judge Reyes Rodríguez agreed with this distortion, but said that the current rules should be applied without interpretations, so he could not vote against confirming the qualified majority of Let’s Keep Making History “nor for the good intentions of avoiding regressive reforms, such as electing judges and extending the mandate of judges.”
