Supreme Court Judge suspends US$2 billion fine from J&F collaboration agreement – 12/21/2023 – Brazil

Judge Dias Toffoli, of the STF (Supreme Federal Court), suspended this Wednesday (20) the payment of the fine of R$ 10.3 billion (US$ 2 billion) imposed on J&F in the leniency agreement of the group of brothers Joesley and Wesley Batista.

In the same precautionary measure (provisional decision), Toffoli authorized the business group to have access to all of the messages from Operation Spoofing, which contain conversations between prosecutors from Operation Lava Jato.

J&F has not expressed itself. The company requested authorization to “correct the abuses that have been committed […]so that in the scope of the CGU only annexes with illegality recognized by the applicant are considered”.

The decision responds to an appeal presented by J&F in November, after the discount of almost R$ 7 billion from the fine was annulled by the Institutional Council of the MPF (Federal Public Ministry).

Toffoli’s wife, Roberta Rangel, is a lawyer for the Batista brothers group, responsible for acting in the dispute between the company and Paper Excellence for control of Eldorado Celulose.

The leniency agreement was signed within the scope of Operation Greenfield in 2017 due to the damage to the public administration and pension funds derived from the crimes attributed by the Prosecutor’s Office to executives of the group.

In the criminal sphere, the leaders signed a denunciation agreement and confessed to illegal acts, such as having paid millions of reais in bribes to politicians and public agents.
