The Supreme Court of the United States accepted this Friday (5) to receive the process in which it will be decided whether Donald Trump can run for president of the United States in the state of Colorado.
On December 19 last year, the Colorado Court ruled that the former president cannot participate in this year’s elections because he was involved in an insurrection by not accepting his defeat to Joe Biden in 2020.
The former president asked the Supreme Court to reverse Colorado’s decision. The case is scheduled to be heard on February 8.

Why Donald Trump could be punished
There is a clause in the United States Constitution that states that a person who took part in an insurrection while holding public office cannot hold a leadership position again. This is a norm from the country’s Civil War era.
In addition to the Colorado Court’s decision, on December 28, 2023, the Secretary of State for the state of Maine, which has electoral justice authority, also prevented Trump from participating in the presidential elections in the state.
The two states decided that, by encouraging the invasion of the US Congress building on January 6, 2021, Trump participated in an insurrection.
