Suspended caregivers: the Minister of Health announces their reinstatement by decree, before the examination of a law repealing the vaccination obligation in the National Assembly

HEALTH – On April 1, the Minister of Health François Braun announced that non-vaccinated caregivers would be reinstated in their role from the “me”. The publication of a decree to this effect should not delay any longer. An announcement that comes at the right time, while Thursday, May 4, a Law proposition aiming to repeal the vaccination obligation in the medical sectors will be studied in the National Assembly. Is the government seeking to set aside the examination of this proposal in order to avoid questions around the repeal of the law of August 5, 2021 and the remuneration of suspended staff?

As a reminder, on April 12, the Social Affairs Commission examined the bill in question. The presidential majority had rejected it outright.

However, the rapporteur Jean-Victor Castor had indicated that the question of the repeal of the vaccination obligation would be examined in the Assembly on May 4. This is why it seems very appropriate for the government to announce the imminent arrival of a decree in favor of the reintegration of caregivers just before this date.

One might be tempted to think that the presidential majority and the affiliated groups might want to set aside the examination of the text on the pretext that a decree on the subject is being prepared. And for good reason, this bill will give rise to a debate that the government wants to avoid.

The interest of the decree: keeping the possibility of reintroducing the vaccination obligation

Since an opinion issued on March 30 by the High Authority for Health (HAS) which recommended “to lift the obligation to vaccinate against Covid-19”health professionals, we know that non-vaccinated staff will be reinstated. The challenge now is to understand under what conditions.

By proposing a mechanism by decree, the Minister of Health François Braun is only suspending the law of August 5, 2021. Indeed, the deputies who support the regulatory path have not hidden the fact that they wish to be able to return to the obligation to vaccinate in the event of an epidemic resumption.

An epidemic resumption which could be observed both nationally and internationally, if the International Treaty on Pandemics emanating from the WHO comes into force next year. In short, a non-vaccinated caregiver who will be reinstated in his duties at the hospital tomorrow, could just as well be suspended again afterwards.

The objective for the government will therefore be to avoid the repeal of the law at all costs by passing a decree. And going this route also allows him not to address the question of the remuneration of staff unjustly deprived of their means of subsistence.

The question of compensation for suspended caregivers

It should be noted that the question of the remuneration of suspended staff is the major absence of this bill. Fortunately, amendments to the text can always be proposed. Fédéric Cabrolier, RN deputy for Tarn, has tabled and will defend an amendment on financial compensation for suspended students and students on May 4.

During the meeting of the Social Affairs Commission on April 12, the deputy Frédéric Falcon (RN) complained that those he filed on this subject were systematically excluded. Parliament had always refused to examine the question until now, but now that this bill has arrived in the hemicycle, it no longer has a choice.

On the other hand, not sure that the decree which is currently in the boxes of the Ministry of Health wants to do the same.
