Takala refuses to open Parliament Constitutional Court in Benghazi

A statement attributed to the Supreme Council of State issued by the media office of Mohamed Takala condemned the opening of the headquarters of the “Constitutional Court” in Benghazi on Thursday, September 19, describing it as “alleged.”

The statement stressed that this step is irresponsible and constitutes a violation of the principle of separation of powers, an attack on the independence of the judiciary, and an attempt to undermine its unity and weaken its role.

Takala described the statement as a “systematic action” to drag this institution into the political conflict, and rejected these actions that violate the interim constitutional declaration, international agreements, documents and decisions, as well as the applicable national legislation and the rulings of the Libyan Supreme Court.

Muhammad Takala Al-Bayan also called on the public authorities in the country and natural and legal persons not to take these actions into account, considering them “unconstitutional.”

Takala explained in the statement that establishing this type of court is a constitutional jurisdiction that no one can claim to possess, especially at this sensitive transitional time and circumstance.

Mohamed Takala sent a strongly worded message to those who are carrying out this work, participating in it and attending it, warning them of its danger and the consequences of insisting on continuing it, calling on the judiciary to adhere to its unity, defend its neutrality and commit to preserving its institutions and its role in protecting the country and public order.

The statement called on all members of the judicial bodies, regardless of their roles and positions, to limit their dealings to the existing, recognized constitutional judicial authority institutions, and not to identify with the parallel approach referred to, according to the statement.

Takala called on the United Nations Support Mission in Libya not to take this action into account and to clearly express its serious and frank position towards it.

The Constitutional Court was established by Law No. 5 of 2023 issued by the House of Representatives, before the Constitutional Chamber ruled that it was unconstitutional.
