New Delhi ‘Individual freedom is very important. The Supreme Court has stated that a person cannot be kept in jail unnecessarily without due legal permission.
Kapil Wadwan and Dheeraj Wadwan, the heads of a construction company called DHFL, were jailed in a case of fraud in ‘S’ Bank. Bombay High Court granted bail as no chargesheet was filed against them.
Against this, the Supreme Court bench headed by Justice KM Joseph said:
According to Section 1 of the Criminal Procedure Code, if a charge sheet is not filed within 60 or 90 days from the date of arrest, the accused can be automatically granted bail.
It is the duty of the government to prevent crime and ensure security. At the same time individual freedom is also important. One cannot be imprisoned unnecessarily.
