Tax authorities in São Paulo innovates with the publication of guidelines

With the aim of ensuring that the work of the São Paulo Tax Authorities is carried out in a transparent manner with society, in line with the best practices of tax administrations, the Department of Finance and Planning of the State of São Paulo (Sefaz-SP) has taken another step.

For this reason, the Coordination of Inspection, Billing, Collection, Data Intelligence and Service (CFIS) prepared the document “Guidelines for Inspection Planning 2023-2024”, which is available for consultation by citizens, taxpayers, organized civil society entities, among other interested parties, on the Sefaz-SP website.

According to the CFIS coordinator, Cleber Stefani, the intention of disclosing the “Guidelines” is to provide greater transparency regarding the performance.

In addition, this disclosure provides important information for all interested parties, improving communication, since the measure presents, in a simple and objective way, the work carried out by the Tax Authorities on behalf of society.

In addition, the work of the Tax Authorities also indicates the paths to be taken in search of continuous improvement of the services provided.

“It is a great step forward for the São Paulo tax authorities, with the perspective of changing the approach and expanding the focus of institutional action, seeking to improve the business environment in the State of São Paulo to attract even more investments, on the one hand, stimulating compliance tax, through the use of incentive instruments – for example, self-regulation, and, on the other hand, deepening the use of specific repressive measures – necessary in cases of fraud and structured evasion – that harm fair competition in the economy of São Paulo”, explains Stefani .

The material provided is divided into:

Tax Compliance; Data sources and inspection model; Inspection Guidelines – 2023 to 2024; ICMS; Regulatory and procedural changes; Sector Focus; A new approach to enforcement; Causa Mortis and Donation Transfer Tax (ITCMD); Motor Vehicle Ownership Tax (IPVA); Final considerations.

According to the “Guidelines”, the tax inspection aims to verify the regularity in the fulfillment of the tax obligations by the taxpayers.

With this, the objective is to ensure correct compliance with tax rules, isonomy and competitive equity, combating practices that are harmful to the State and the business environment, as well as ensuring the collection of taxes to the State.

In addition, they also expose inspection planning information on the Tax on Circulation of Goods and Services (ICMS), new approaches in ITCMD and IPVA inspections.

Stefani also reinforces that the idea is to strengthen institutional contacts, favoring the development of the organizational skills of the São Paulo Tax Authorities.

“The plan deals with general guidelines for inspection and should not be considered as a limitation of actions that may be necessary throughout the year to fulfill the institutional mission of the São Paulo tax authorities”, he concludes.​​
