It is a difficult and stony path on which the government has embarked. The Council of State has just made public a second opinion this Wednesday setting out the narrow conditions which could allow Bercy to tax motorway companies as it wishes. A very restrictive framework which should not spare the airports either, even though the executive is still looking for a way not to penalize them too much.
Last spring, the government affirmed its intention to get its hands on part of the generous profits from motorway concessions. He then requested the Council of State to determine which was the most practicable route. A first opinion indicated that the one involving a shortening of the duration of the concessions was not legally practicable.
