The Public Prosecutor’s Office is sending subpoenas to OSE officials for the leak of recorded audio material, immediately after the deadly tragedy in Tempi.

According to information, seven executives of the OSE, including the CEO of the Organization, are being called to account by the First Instance Prosecutor Ioannis Pierros for the crime of jointly violating official confidentiality.

The calls, apart from the head of the OSE, also concern employees of the Organization who, based on the evidence of the prosecutor’s investigation, appear to be involved in the leakage of the material with the recorded dialogues of the train drivers on the night of the collision of the two trains that resulted in the tragic death of 57 passengers on the two trains.

The prosecutor’s investigation did not include the complaints about interventions – editing – in the audio material that was made public, as it was legally assessed that it cannot be assessed criminally since it was not caused by the alleged alteration, a legal consequence. And this is because in the hands of the Larissa investigator who is handling the investigation of the case of the tragedy, all the recordings of the fateful night have been handed over without alterations from the beginning.

It should be noted that the calls for innocent explanations do not include those who published audio material, since in order to incur criminal liability in a similar case, the publication must cause damage either to the State or to another natural or legal person. This parameter did not emerge from the prosecutorial investigation conducted.
