A Texas woman has filed an emergency lawsuit asking a judge to allow her to terminate her non-viable pregnancy. Kate Cox, a 31-year-old mother of two, recently learned of a fatal chromosomal condition in her unborn baby and has been unable to get an abortion due to multiple state bans in Texas.
Cox’s doctors have informed her that continuing the pregnancy poses a serious threat to her life, health, and future fertility. Despite the devastating diagnosis and recommendations from medical professionals, Cox has been blocked from obtaining an abortion due to Texas’s severe abortion bans.
The lawsuit, filed in state court, marks the first time since the Roe v Wade ruling in 1973 that an adult woman has asked a court to authorize an abortion. Specifically, Cox is seeking a dilation and evacuation (D&E) procedure, which her doctors have identified as the best medical option for her health. However, healthcare providers in the state are hesitant to perform the procedure due to the threat of prosecution under Texas’s criminal abortion ban.
Cox and her husband, Justin, are seeking legal intervention to allow them to proceed with the necessary medical care without fear of legal repercussions. The couple’s case is being represented by lawyers from the Center for Reproductive Rights, who are also involved in a separate case against the state on behalf of 20 women and two OB-GYNs.
