The lawyer of the victim of the sexual abuse for which the footballer Santi Mina, former Celta de Vigo player, was sentenced to four years in prison has requested the Superior Court of Justice of Andalusia (TSJA) to order the “immediate” entry into a forward penitentiary center.

The lawyer Iván Bolaño has highlighted in a document, presented in August and consulted by EFE, that the sentence imposed by the Provincial Court of Almería was ratified last July by the TSJA, after which his client has had “certainty of the recent and novel information that substantially modifies the situation of the accused.”

In this sense, remember that Celta de Vigo has terminated Mina’s contract as a result of this ruling, which “means that, today, there is no employment relationship that unites the convicted person to Spain, which was precisely the reason “The defense invoked it when the convicted man moved to Saudi Arabia for an entire year last season.”

The lawyer maintains that given the sentence, imprisonment would be “mandatory,” especially when he no longer has work or professional ties that “tie” him to Spain, which also has “an indisputable economic capacity (of a record greater than the million euros per year that he would have been receiving) that would enable him to establish himself, without problems, in any country in the world.”

Likewise, he emphasizes that for a year, the same one in which he was assigned to Al-Shabab, he was “living and adapting” in Saudi Arabia, a country “6,650 kilometers” from Spain and without an extradition agreement.

“These elements undoubtedly pose the real and material possibility of an eventual escape from our country, which would make it practically impossible to ensure compliance with the two convictions handed down against the convicted person,” he adds.

For this reason, he requests that as a “main and appropriate measure” his immediate entry into prison be ordered or that, failing that, he be forced to appear “apud acta” (in person), before the TSJA on a weekly basis, as well as “as many times as he is called.” , and that in addition his passport is taken away and he is prohibited from leaving the country.

Already in September, the lawyer presented a second brief to the TSJA in which he insisted on these same requests, because despite “Mina’s defense” reiterating his supposed willingness to seek justice, he has “again intended to leave the country with apparent work reasons, without informing” the High Court.

He points out that he has tried to “formalize a work contract abroad, having heard of it only and exclusively through the press”, and maintains that the footballer’s departure from the country has not occurred because his signing for Sampdoria “has been “frustrated by fans’ complaints.”

“This predictably leads us to understand that the convicted person continues to search for work outside the country to have a reason to abandon it, which, as this party has always maintained, exponentially increases the risk of escape and the fulfillment of the sentence.” imposed,” he says.
