The Attorney General’s Office has issued an urgent call to the directors of Colpensiones and the Private Fund Administrators (AFP) to comply with the provisions of Law 2381 of 2024.
This law seeks to prioritize the process of transferring the pension regime for those citizens who already meet the established time and age requirements.
In its role of monitoring and guaranteeing the legal system, the Public Ministry urged members of the social security system who meet the transition criteria to take advantage of the window of opportunity offered by the law to carry out the transfer of regime without obstacles. This measure is intended to facilitate the process and ensure that beneficiaries can access their rights without having to resort to lawsuits.

One of the most relevant aspects of the Attorney General’s requirement is the mandatory implementation of double counseling for members who have contributed at least 750 weeks (in the case of women) or 900 weeks (for men) and who are less than 10 years away from reaching the minimum pension age. This mechanism seeks to guarantee that citizens receive clear and precise guidance before deciding to change their regime.
The Attorney General’s Office for Labor and Social Security Affairs also urged pension administrators to strictly comply with current regulations.streamlining the process of transferring the regime through administrative channels and thus reducing congestion in the courts. In addition, it was emphasized that responsible entities should not impose additional requirements that are not contemplated in the law, which could hinder the process.
Finally, the control body stressed the need to follow the guidelines established by the Financial Superintendency of Colombia in the circular issued on September 10, 2024. This circular urges Colpensiones and the AFPs to hold massive information and advisory sessions to facilitate the access of affiliates to the benefits of Law 2381 and accelerate the pension transfer procedures.
