The Attorney General’s Office conducted an investigation into an operation carried out on July 25, 2022, by uniformed officers assigned to the Sucre Police Department, in the sector known as the La Garita intersection, in the town of Chochó (Sucre), in which a lockdown was carried out following the death of the police patrolman, Diego Felipe Ruiz Rincón, in the municipality of Sampués.
Where initially members of the Child and Adolescent Protection Group of the aforementioned institution, required three citizens identified by the names of Carlos Alberto Ibáñez Mercado, Jesús David Díaz Monterroza and José Carlos Arévalo Contreras, people who were later embarked in an institutional vehicle of the Police, in order to transfer them to the nearest medical center and thus provide them with hospital assistance, considering that they had a series of injuries in their humanity, but during the trip from the aforementioned place to the María Reina clinic, in the city of Sincelejo, they received several gunshot wounds by officer Benjamín Darío Núñez Jaramillo, lieutenant colonel (now retired). The aforementioned captured people were declared dead at the aforementioned medical center.

The Disciplinary Delegate Prosecutor’s Office of Court 1, by ruling of August 23, 2024, declared Benjamín Darío Núñez Jaramillo disciplinarily responsible in his capacity as operational commander of citizen security DESUC, in his rank of lieutenant colonel at the time of the events, because the charge attributed to him was proven and not disproved, for the commission of a very serious offense provided for in the paragraph of article 45 of Law 2196 of 2022 (Police Disciplinary Statute), consisting of the commission of a conduct described in the law as a crime, that is, article 103 of the Penal Code, which describes the crime of homicide and, consequently, a disciplinary sanction was imposed, consisting of dismissal and disqualification from holding public office in any position for 19 years.
