The Bank of Spain issues a warning about negative balances in joint accounts

In cases where there are joint owners of a bank account with indistinct disposition, the responsibility for possible overdrafts is not always shared, according to the bank.

The Bank of Spain points out that in situations of this type, there are several aspects to consider before assuming that responsibility is joint. For example, if a single owner makes an authorized payment that exceeds the available balance and results in an overdraft, the non-responsible joint owner could file a claim in court. Furthermore, the actions of the banking entity could be considered contrary to appropriate banking practices in cases where the credit card or loan belongs to a single owner, the other owner is not aware of the direct debit payments or the contract of the account does not contemplate the possibility of overdrafts in these circumstances.

Finally, it warns that when card or loan contracts only bind the original signatories, entities are turning the co-owners into guarantors of the financing without their consent.
