The 34-year-old worker, who had been working as a salesperson for a company in Lower Austria for one and a half years, was dismissed in March 2023 when he could not go to work due to illness. The employee who received the termination notice just ten days after the start of his sick leave – during which he was still on sick leave – also had his salary cut at the end of the notice period.

However, the employer did not take into account the legal provisions. The salesperson was entitled to continue receiving wages for eight weeks at full pay and four weeks at half pay until the end of the sick leave. However, the boss did not accept this and refused to pay the outstanding amount. He claimed that the sick leave certificate was not filled out correctly. The dispute escalated and a lawsuit was eventually filed, resulting in a claim for damages totaling 13,000 euros.

But that wasn’t the end of the story. Upon closer examination, it turned out that the terminated employee was entitled to more payments. Besides the agreed commissions, overtime and extra working hours were never paid by the boss. Desperate, the employee turned to labor law experts at AK Niederösterreich. Under the leadership of President Markus Wieser, the case was taken up and the situation was examined in detail. Experts found that the employer violated several provisions.
