The acting Attorney General of the Nation, Eduardo Casalruled against the former president Cristina Kirchner and he thought that the Supreme Court of Justice must reject an appeal presented by her and confirm her processing by 175 cases of receiving bribes in the case of the bribery notebooks.

If the Court agrees with Casal and rejects the complaint, the way is paved for the oral and public trial, without a date yet, which is located in the Federal Oral Court number 7, in charge of the judges Enrique Méndez Signori, Germán Castelli and Fernando Canero.

Cristina Kirchner was prosecuted for illicit association in this case and later her prosecution was expanded for 175 cases of passive bribery; that is, the receipt of bribes. The Federal Chamber rejected the former president’s appeal against this latest ruling, because it was not a final ruling.

Cristina Kirchner’s defense raised an extraordinary appeal, which was rejected in the Court of Cassation, so she now went to Court with a complaint against the extension of that prosecution.

The defense questioned whether the Cassation chamber that ruled was the one that should have done so, said that this is a “deprivation of justice” and that the case is comparable to a final sentence due to “the very exceptional characteristics of the case” and “the enormous institutional gravity of the file.”

However, Casal understood that the appeal is not directed against a final sentence or one comparable to such. And he wrote that with the reasons given, the defense seeks to “justify the intervention of Your Excellency.” [por la Corte] in this instance, instead of postponing it to the appeal stage of an eventual adverse final ruling.”

Regarding the defense’s proposal about the Cassation chamber that should have intervened, the Prosecutor said that this issue has already been resolved and that the other objections he made about the validity of the evidence or the alleged non-compliance with procedural forms do not correspond to this stage. , but to the ordinary courts in the later stages of the trial.

“I do not appreciate that the decisions adopted in the sub-examination, which the party finds adverse, allow it to be affirmed that it has been subjected to a total deprivation of justice that justifies equating the questioned indictment with the final sentence,” Casal wrote and ruled to reject the former president’s complaint.

The cause of the bribery notebooks, the product of an investigation by THE NATION, is already elevated to oral trial. The court allowed all the accused, the plaintiffs and the prosecution to offer the evidence that they will use in the process. That is, which witnesses they hope to call, what documentation they want to include and whether they will request measures prior to the beginning of the hearing, such as new expert reports. Now, the judges are analyzing what evidence they admit and what they do not.

The main defendant in this case is Cristina Kirchner, as the alleged head of an illicit association. The accusations arose from Oscar Centeno, a driver for the Ministry of Planning who wrote down in notebooks the trips he made with ministry officials to collect bribes paid by businessmen. “Regretful” officials admitted the charges and the businessmen acknowledged the payments before the Court. Some of those trips ended at the former president’s apartment in Recoleta.

There are 159 people charged, all of them free. This case, strictly speaking, is not a single file but rather there are 10 files that are connected and therefore processed as a set. These files involve 26 legal qualifications and cover, in total, 540 acts of corruption, which are mostly payments and receipts of bribes.

The defendants have been filing various annulment appeals to frustrate the trial or exclude their statements as “repentant,” statements in which they admitted having made payments to the businessmen. The prosecution objected in all cases and the federal oral court resolved the same.
