“In a constructive approach, our confederation has spared no effort in developing a law meeting the expectations of all social partners, particularly the private sector, and ensuring a balance between rights and obligations and in phase with the provisions of the Constitution of the Kingdom”, indicates the CGEM in a press release.
Indeed, this law must guarantee on the one hand to workers the right to strike, and on the other hand to non-strikers a certain number of rights and freedoms, including freedom of work, recommends the Confederation. It must also ensure that the exercise of the right to strike does not endanger the company and in particular very small, small and medium-sized enterprises (SMEs), which are particularly suffering from the current situation.
As a reminder, the social agreement of April 2024 provided for the promulgation of this law during the 2024 spring parliamentary session. Since then, the bill has been the subject of extensive consultations with constitutional bodies such as the Economic, Social and Environmental Council (CESE), the National Human Rights Council (CNDH), as well as with the majority of representative unions in social dialogue and in the Chamber of Advisors.
The project was adopted in the House of Representatives on December 25 following discussions which led to the tabling of 334 amendments. The current debate at the level of the Chamber of Councilors will make it possible to collect new recommendations and further enrich this text.
“The CGEM, through its parliamentary group, will also make its contribution, on points that it considers essential and which do not appear in the current version of the bill. It remains confident about the rapid promulgation of this law, awaited for 62 years, in favor of strengthening the competitiveness of Moroccan companies, particularly SMEs, and promoting the economic attractiveness of our country”, concludes the press release.
