An article entitled “CONSULT ADMITS: WE EXPLOITED “SCIENCE” TO MAKE POLITICS” signed by Maddalena Loy was published on April 14, 2023 in La Verità.
The article reveals a worrying truth: Sciarra, president of the Consulta, admitted to having used “science” as a tool to justify the vaccination obligation and therefore the sacrifice of the fundamental rights of the individual in favor of the community. Contrary to what one would expect, the court did not limit itself to verifying the constitutionality of the provision, but also evaluated its merits, thus replacing the legislator.
However, Sciarra clarified that by “science” she refers to the WHO, Aifa and other organizations that disseminate scientific and statistical data in Italy and around the world. He also stated that these scientific bodies are infallible, and that therefore the court takes care of adapting their requirements to the constitution, effectively rewriting it.
We are therefore faced with a situation in which politics relies on science to justify decisions that often require the violation of citizens’ fundamental rights, with the court adapting the constitution to the will of scientific bodies. This leads us to reflect on the relationship between science and politics, and on the need to guarantee respect for fundamental rights in every choice that involves some kind of sacrifice for the citizen.
Now we truly feel powerless in the face of a pervasive power against which there is no longer any dam. It might as well have been that the Constitutional Court had never been established, given that only the preservation of spirituality remains, that is man’s innate desire for freedom to counter nonsense and rampant pride.
