The High-ranking Official Crimes Investigation Office, which is investigating the December 3 declaration of martial law, began a last-minute review of the re-execution of the arrest warrant for President Yoon Seok-yeol, one day before the expiration date of the arrest and search warrant on the 6th. The deadline for the arrest and search warrant for President Yoon, which the Corruption Investigation Office requested and issued from the Seoul Western District Court, is until midnight on the 6th, and unless other measures such as re-applying for the warrant are taken, this is the last opportunity to re-execute the arrest warrant.

According to the legal community on the 5th, Oh Dong-woon, head of the Corruption Investigation Office, went to work at the Gwacheon Government Complex on the weekend and discussed the timing and method of executing arrest warrants with Lee Dae-hwan, head of the emergency martial law task force and chief prosecutor of the 3rd investigation department. The Corruption Investigation Office initially placed emphasis on executing arrest warrants based on the principle that “issued arrest warrants must be executed in principle,” and on the afternoon of the 4th, Acting President Choi Sang-mok, Deputy Prime Minister and Minister of Strategy and Finance, requested the Presidential Security Service to cooperate in executing the arrest warrant. An official letter was sent saying, “Please command.” However, as they did not receive a reply until the 5th, it was reported that they were in trouble as to whether it would be realistically possible to execute the arrest warrant. Acting President Choi Sang-mok reportedly plans to refrain from intervening based on the internal conclusion that ‘the acting president does not have the authority to command the Secret Service.’ On the 3rd, when the Corruption Investigation Office’s arrest warrant was executed, Acting Director Choi expressed his position in principle, saying, “I expect the Secret Service and the Corruption Investigation Office to carry out (execution of the warrant) while adhering to the law and procedures.”

Accordingly, the Corruption Investigation Office is also considering a plan to immediately request an arrest warrant. It is unusual to request an arrest warrant without investigating the suspect, but on December 10 last year, the Corruption Investigation Office also requested an arrest warrant without an investigation for former Minister of National Defense Kim Yong-hyun (who is in prison), who led the martial law situation. An official from the Corruption Investigation Office said, “We are considering three main frameworks: whether to re-execute the arrest warrant, extend the arrest warrant’s deadline, or move on to an arrest warrant without executing the arrest warrant.”

The ruling and opposition parties continued their battle over the weekend over the execution of President Yoon’s arrest warrant by the Corruption Investigation Office. People Power Party Emergency Response Committee Chairman Kwon Young-se said at the National Assembly on the 5th, “The President is currently in a de facto state of pension,” and added, “Nevertheless, the Corruption Investigation Office’s unreasonable and unreasonable plan to execute warrants and even arrest people is just a ‘show-off show’ to shame the President. ‘” he said. It is reported that dozens of People Power Party lawmakers will take group action to block the Corruption Investigation Office if it executes an arrest warrant on the morning of the 6th. Noh Jong-myeon, floor spokesperson of the Democratic Party of Korea, also said, “If the Corruption Investigation Office is not confident, there is also the option of re-transferring it (to the police).” The Democratic Party put pressure on the National Security Agency, which blocked the execution of the arrest warrant, saying, “We may revise the National Security Act and disband the National Security Agency.”

Meanwhile, the Seoul Western District Court dismissed the objection filed by President Yoon’s side to not allow the execution of arrest and search warrants.
