The administrative court in Varna disregarded the request to suspend the preliminary implementation of a decision of the Municipal Election Commission (MEC) in Varna, which prematurely terminated the powers of Nikolay Zhelyazkov as mayor of Primorski district, the press service of the court announced.

In its reasons, the court states that relevant to the suspension of the permitted preliminary execution of an administrative act under a separate law are the facts from which it can be reasonably concluded that the preliminary execution of the act will cause significant or difficult to repair damage to the disputant. There is no provision for suspending the permitted preliminary implementation of the administrative act on the grounds that its implementation may cause significant or difficult-to-repair damage to third parties.

The court accepts the claim of the applicant that he will suffer pecuniary damage as a result of the fact that he will not receive remuneration for the period of consideration of the case, without indicating whether the remuneration as a mayor is the person’s only income and without providing evidence regarding these facts, as insufficient to justify a conclusion that the applicant will suffer difficult to repair damage or significant damage.

The court concludes that the request to suspend the preliminary implementation of the decision of the OIC – Varna is groundless and should be disregarded.

The court scheduled the hearing on the merits of the appeal for February 21 at 1:40 p.m.
