The defense of the former mayor of Recoleta, Daniel Jaduerequested this Thursday to the Court of Appeals of Santiago disqualify three judges who reviewed their case.

For the above reasons, defense attorney Juan Carlos Manríquez seeks to have these judges removed from the case against Daniel Jadue, who is charged with crimes of bribery, disloyal administration, tax fraud and fraud, within the framework of the Farmacias Populares case.

Regarding the arguments presented to make the request before the Court, the defense attorney stated that “A prior opinion has been expressed by the three judges whose recusal is requested, on the pending matter at hand, and in particular, on the precautionary measures affecting my client, with full knowledge of the cause.”

“There is no doubt that in the present case we are faced with a personal incapacity affecting the three judges referred to, a matter that must be declared by Their Excellencies. One of the purposes of the disqualifications provided for in our legislation is to ensure that judicial officials act free from influences external to the law. and the background of the process,” added Juan Carlos Manríquez in the document.

In this context, Jadue’s defense estimated that the judges’ resolutions could constitute “a confirmatory bias that will hardly be modified in the future“.

Regarding the next hearing to review the precautionary measures of the Communist Party militant, this is scheduled for this Monday, September 2nd.
