(Amant Gushkuri) Senior Supreme Court Judge Justice Mansoor Ali Shah emphasized that failing to implement the Supreme Court’s decisions would be unconstitutional. He stated that it is a constitutional requirement to adhere to the Supreme Court’s rulings. In the current system, any deviation from the court’s decisions would necessitate a fundamental change in the judicial framework. The judge expressed his determination to implement the court’s decisions to the best of his abilities.
Justice Mansoor Ali Shah addressed an event in Islamabad titled “Overcoming the Challenges Faced in the Implementation of Judicial Decisions.” He clarified that he was not the Acting Chief Justice of Pakistan, but the most senior judge. He emphasized the health and well-being of Chief Justice Qazi Faiz Isa. The judge stressed the importance of implementing the Supreme Court’s decisions, citing the 2014 ruling on fundamental rights for minorities as an example.
Justice Shah emphasized that the non-implementation of court decisions undermines the constitution and the authority of the judiciary. He warned against any attempts to interfere with the independence of the court or undermine its decisions. The judge highlighted the need to uphold the principle of separation of powers and ensure equal rights for all citizens, regardless of their religious or ethnic backgrounds.
The senior judge emphasized the importance of fostering inter-religious harmony and tolerance. He criticized negative perceptions and discrimination against minorities, citing Islamic teachings and historical examples of respect and tolerance towards religious minorities. The judge called for a collective effort to promote understanding and mutual respect among different faiths.
Justice Mansoor Ali Shah pointed to the Supreme Court’s previous rulings that protected quotas for minorities in government jobs and ensured equal rights for all citizens. He emphasized the need for government action and public awareness campaigns to promote interfaith harmony and address the underlying causes of social tensions.
