The central government has filed an affidavit in the Delhi High Court opposing the Delhi Waqf Board’s petition against 123 properties. In it, the Center has said that the Delhi Waqf Board cannot be the owner of these properties, but only a caretaker.

The Center has said in an affidavit that the Delhi Waqf Board cannot oppose the assessment of waqf properties, but it should clarify the status of these properties. The Center said that some of the properties are leased, so they cannot be called waqf properties. The affidavit states that the Delhi Waqf Board has been established under the Waqf Act.

It may be noted that on March 7, the court had refused to order restoration of the stay on the Centre’s order. Advocate Rahul Mehra, appearing for the Waqf Board, submitted that the Center has given a very flimsy reason to seize the properties of the Waqf Board that the Waqf Board has no interest in these properties. These properties have been inspected at least five times and each time they have been found to belong to waqf. The final inquiry was conducted by a one-member committee appointed by the Centre.

The Center has decided to take over these properties which the Waqf Board is opposing. The Delhi Waqf Board has filed a petition challenging the letter issued by the Center on February 8, which asked for the seizure of 123 properties of the Delhi Waqf Board. Senior advocate Rahul Mehra, appearing for the Delhi Waqf Board, said that the central government has no right to seize the property of the Waqf Board. The demarcation of these properties of the Waqf Board was done in the surveys of 1970, 1974, 1976 and 1984 and was agreed to by the President of the Republic.
