The dispute between Al-Mishri and Takala… the judiciary enters the line

The South Tripoli Primary Court has ruled to reject the request submitted by 3 members of the State Council regarding the invalidity of the session to elect the Council President and its outcomes.

The court responded to the members’ request based on the participation of two members whose membership in the council had expired, saying: “Abdel Salam Ghuwaila and Fawzi Al-Aqab” attended the session publicly and their names were read out to the attendees and in a voice without anyone objecting to their participation.

The decision of the President of the Court also indicated that the participation of the two members was not objected to until after the end of the election process, which the Court’s decision considered a basis for rejecting the request.

The Legal Department of the Supreme Judicial Council informed Khaled Al-Mishri that it was not competent to adjudicate the “ballot paper” dispute in the State Council presidency elections.

The administration added in its response to Al-Mishri’s request to resolve the dispute, that the matter requires referring it to the competent judiciary to resolve it, in accordance with the provisions of the Council’s internal regulations.

Al-Mishri had asked the Council’s Legal Department to provide a legal opinion on the validity of a ballot paper that was disputed during the election process for the presidency of the Supreme Council of State on August 6 of this year.
