The Executive Power will have a period of 90 days to regulate the laws

Constitution and Regulations Committee approves opinion

In order to guarantee the timely regulation of the laws for the benefit of the population and to prevent, in practice, the laws approved by Congress from being vetoed, the Constitution and Regulations Commission approved by majority the opinion that establishes a period of 90 days for the Executive Power to fulfill this function.

The proposal, which modifies the Organic Law of the Executive Power, establishes that if the Executive Power fails to comply with this term, it will constitute an infraction of the Constitution, being the obligation of Congress to denounce it for this concept.

In the substitute text of the legislative initiative, authored by Congressman Luis Aragón Carreño (AP), the commission proposes a period of 120 business days to regulate the ones that are missing, up to the present.

The president of the commission, Hernando Guerra García Campos (FP), pointed out that from 2016 to date, there are 87 laws that do not have regulations, and, consequently, cannot be executed.

He indicated that 74 of the enacted laws have expired, seven are within the deadline and six do not have a deadline.

“This means a lack of interest on the part of the Executive Branch, which results in non-compliance with the laws; in practice, a question of veto and that the development of the norms for the benefit of the population is not guaranteed”, he said while adding that the balance of powers is violated, in addition to the possibility that the norm is distorted.

Aragón Carreño said, for his part, that the approval of the proposal will allow non-compliance with this function to be sanctioned and generate political and administrative responsibilities in the responsible officials.

Congressmen Alejandro Muñante Barrios (RP), Alejandro Cavero Alva (Avanza País) and Ilich López Ureña (AP) spoke in favor of the initiative. For her part, Ruth Luque Ibarra (CDJPP) spoke out against it, considering that this issue was already regulated in the Regulations of Congress.

On the other hand, the commission approved by majority, the proposal that modifies Legislative Decree 1326, Legislative Decree that structures the administrative system of legal defense of the State.

The legislative initiative seeks to preserve administrative autonomy and functional independence in the designation of public prosecutors of the Legislative and Judicial Power and autonomous bodies and preserve the separation of powers in a rule of law.

BICAMERALITY

The president of the commission announced that the renewal project will be discussed by halves next week and the opinion will be seen in the subsequent week.

Likewise, at the request of several congressmen, he said that the discussion on the bicamerality will be resumed, which is under reconsideration in Congress to see if an agreement is reached and it is unlocked and voted on in the following months.

LIFTS

The legislators, in part of the session, had the opportunity to support their proposals.

In this sense, parliamentarian Alejandro Muñante Barrios (RP), author of Bill 1142/2021-CR, did the same regarding his proposal to modify article 11 A and incorporate article 25-A into Law 28094, Law on Political Organizations.

The objective is to establish and ensure that people with a conviction issued in the first instance, as author or accomplice, for the crime of corruption of officials, are prevented from holding positions in government bodies and / or managers in parties and organizations policies, in order to prevent corruption within political parties and organizations.

For his part, Congressman Alex Paredes Gonzales (BMCN), author of Congressional Legislative Resolution Project 3012/2022-CR, which proposes to modify article 34 of the Regulations of the Congress of the Republic in order to allow the greatest participation of the congressmen of the Republic in ordinary commissions and others.

Finally, congressman Eduardo Salhuana Cavides (APP), author of Bill 4215/2021-CR, proposes modifying article 21 of Law 26859, Organic Law of Elections, in the sense that the National Election Jury assigns each constituency of not less than two seats.
