Recently, the historian Michael Wolffsohn said on television that international law is “excellently suited to combating an aphid.” The polemic puts its finger in the wound: the sword of international law is often not as sharp as it should be in view of the atrocities committed or initiated by state leaders. But statements like Wolffsohn’s made to a broad public give the impression that international law is just a nice accessory for fair weather times, but of no use in an emergency. This is an injustice to international law, as the judgments of international courts prove. The German judiciary has also recently become more active.

Federal Justice Minister Marco Buschmann (FDP) wants to continue working on “filling international and German international criminal law with life”. The two Green MPs Helge Limburg and Boris Mijatovic put it even more forcefully: “Germany’s claim is to take a pioneering role in the prosecution of international crimes.” A reform of the German International Criminal Code, which the Federal Cabinet passed last week, should help.
