More than 30 years ago, a couple from the canton of Zurich divorced. In the meantime, the man died and since then his widow has had to pay 14,000 francs to his ex-wife every month.
A recent judgment from the Federal Court highlighted the financial consequences of a divorce which can persist even after death. As a result, a possible new partner may still be required to pay debts. It was therefore decided that even after the death of her divorced partner, an ex-wife is entitled to alimony which must be paid by the second wife of the deceased, as written in the “Daily Gazette».
The case in question concerns a wealthy couple who divorced in 1993. According to the divorce agreement, the man paid monthly alimony to his ex-wife for 29 years. After his death in 2022, his second wife inherited not only his fortune, but also the maintenance obligation to his ex-wife. The federal court ruled that the 1993 agreement had the force of law and that the widow must continue to pay child support. This corresponds to a sum of 14,000 francs per month.
Lawyer Daniel Stoll, who represented the divorced wife in court, stressed that the judgment reflected the social reality of 1993 and not today. At the time, the courts also looked at who was responsible for the breakdown of the marriage. Today, divorces are independent of the “offending” spouse. In addition, alimony is requested only if it is financially necessary.
