A bill proposing to give the regions the right to establish fines for disturbing peace and quiet using cars or motor vehicles has been submitted to the State Duma. The Moscow City Duma proposed to correct the Code of Administrative Offenses (CAO).
The explanatory note notes that unscrupulous owners of cars, motorcycles and ATVs often use faulty or specially modified engine exhaust systems or listen to music very loudly, and existing fines are not enough to combat this problem. Regions are invited to provide the opportunity to set the amount of a fine for “particularly noisy” vehicles (V) depending on the category of this vehicle and the power of its engine.
Residents have repeatedly appealed to the Moscow City Duma and the Moscow government with complaints about the increased noise level due to cars and motorcycles without silencers and with loud music, its chairman Alexei Shaposhnikov (United Russia) pointed out during the discussion of the bill in the capital’s parliament. He called the punishment existing in the legislation too soft and non-working. The fine for violating the silence by motorists is now, according to Shaposhnikov, up to 500 rubles.
According to the draft law submitted to the State Duma, this amount can be multiplied. In particular, part 1.1 will appear in Article 3.5 of the Code of Administrative Offenses, which will indicate that the amount of a fine for citizens and legal entities for committing administrative offenses provided for by the laws of the regions, “encroaching on the peace of citizens and silence and committed using cars or motor vehicles, may be established depending on the category of the vehicle and the power of its engine, and also exceed 5,000 rubles.
“If the engine power of a passenger car exceeds 200 hp. s., then 250 rubles will be added to the fine. for every 10 l. With. beyond this value. For example, the owner of a sports car with 400 “horses” will have to pay 10,000 rubles. In addition, it is proposed to legislate the possibility of fixing violations of the noise level of vehicles with the help of special technical means combined with photo and video recording tools,” Shaposhnikov explained.
Without changes in federal legislation, the regions will not be able to solve the problem of behavior on the roads, Rifat Shaikhutdinov, First Deputy Chairman of the State Duma Committee on Transport and the Development of Transport Infrastructure, told Vedomosti. “The Moscow City Duma turned to us with a legislative initiative, before which, in turn, this issue was raised by Moscow Mayor Sergei Sobyanin. The amendments apply to those who put nozzles on mufflers and turn on music excessively loudly in cars under the windows of residential buildings. It all has to do with bullies, not drivers in general,” he says.

“Testing sound level meters showed the effectiveness of the devices – along with video recording, there is a record of exceeding the noise level. In the future, certification of these sound level meters will follow, the government will develop requirements for their characteristics.
